Employment Immigration

Individuals with a certain mix of skills, education, and/or work experience can qualify for an employment-based immigrant visa including an employment-based green card. Some of the most popular employment-based immigrant visa categories are EB-1, EB-2 and EB-3

EB-1 Priority Workers: Individuals with extraordinary abilities in the sciences, arts, education, business, or athletics (EB1-A) as well as outstanding professors, researchers (EB1-B) and multinational executive and managers (EB1-C) can qualify for this type of visa. The foreign national does not need a certification to qualify. Applicants in the EB1-B and C categories need a US employer to sponsor them.

EB-2 Professionals with Advanced Degrees or Persons with Exceptional Ability: Individuals who are members of a profession holding an advanced degree or its equivalent or have exceptional ability in the sciences, arts, or business qualify. An individual may obtain permanent residency without a labor certification provided they obtain a national interest waiver. A national interest waiver will be granted to those who have exceptional ability and whose employment in the United States would significantly benefit the national economy, cultural, or educational interests or welfare of the United States. In the absence of a national interest waiver, an individual will need a labor certification to obtain a green card in this category.

EB-3 Skilled Workers, Professionals, or Other Workers: Individuals who are classified as skilled workers, professionals, or other workers qualify under this category. In order to obtain permanent residency in the third preference category, a foreign national requires a labor certification and full-time, permanent employment. A skilled worker position should not be seasonal or temporary and should require (2) years of experience or training. A professional position must require a bachelor’s degree or foreign equivalent degree; the occupation myst normally require a bachelor’s degree. To qualify under the other workers category, individuals should be performing unskilled labor requiring less than two years training, education, or experience, not of a temporary or seasonal nature.
